DOJ moves to throw out convictions for Jan. 6 rioters
The Justice Department asked a federal appeals court to throw out the seditious conspiracy convictions of a number of Proud Boys and Oath Keepers, including founder Stewart Rhodes.
They were convicted and sent to prison for their actions on Jan. 6, 2021.
The request was made in a filing signed by U.S. Attorney Jeanine Pirro on Tuesday.
President Donald Trump commuted the sentences of several of the group’s leaders as part of his broad clemency for more than 1,500 defendants charged in the attack. The DOJ’s latest move would go a step further, erasing the convictions.
The request is part of the president’s ongoing efforts to rewrite the history of the Capitol attack, during which his supporters tried to stop the transfer of power after his loss to Joe Biden.
