Detained migrants’ habeas petitions languish in Mississippi court system
A 2025 change to ICE’s mandatory detention policy made bond unavailable to most detained undocumented immigrants, leading to a surge in habeas corpus petitions from those seeking to be released. But in the Southern District of Mississippi, which covers the Adams County detention facility, nearly all habeas cases are assigned to the same judge and almost none of them are ever heard on the merits, leaving detainees locked up with no legal recourse.
